Sogakope High Court Orders Release of Seized Vehicles to Akatsi South Municipal Assembly

In a significant legal victory for local governance, the Sogakope High Court has ordered the immediate release of official vehicles belonging to the Akatsi South Municipal Assembly. The vehicles, which had been under court seizure since 2022, were confiscated as part of a judgment debt stemming from a long-standing land compensation dispute with the Anakpa family of Yaluvi. This ruling marks a major breakthrough for the assembly under the leadership of Municipal Chief Executive Hon. Daniel Dagba.

The dispute originated from land released to the then Akatsi South District Assembly in 1990 for the construction of district offices and the District Chief Executive's residence. After years without compensation, the Anakpa family filed a lawsuit in 2018, leading to a court judgment against the assembly. When the debt remained unsettled, authorities enforced a writ of fieri facias, resulting in the seizure of a Toyota Hilux pickup and other vehicles. The prolonged immobilization of these assets had hampered the assembly's ability to carry out essential administrative and developmental functions.

Upon assuming office, Hon. Daniel Dagba prioritized the recovery of these public assets. He initiated thorough investigations through the Driver and Vehicle Licensing Authority (DVLA), which revealed that certain seized vehicles, including those with registration numbers GR 8864-18 and GR 8502-19, were registered under the Ministry of Local Government and Rural Development, classifying them as government property rather than direct assembly assets. This key evidence paved the way for legal action.

Acting on these findings, the Regional State Attorney, representing the Attorney-General and Minister for Justice, filed a motion on June 17, 2025, seeking the release of the vehicles. The Sogakope High Court granted the application, affirming the proper ownership status and directing their prompt return to the municipal assembly. The decision underscores the importance of due process and strategic legal navigation in resolving public asset disputes.

Residents have widely welcomed the court's ruling, viewing it as a testament to effective leadership and a commitment to safeguarding public resources. With the vehicles back in service, the assembly anticipates enhanced capabilities in project supervision, revenue mobilization, monitoring, and overall service delivery across the municipality.
