Speaker Bagbin Urges Supreme Court to Strengthen Independence and Avoid Overreach

Speaker of Parliament Alban Sumana Kingsford Bagbin has hailed Ghana’s Supreme Court as the most influential institution in giving practical effect to the 1992 Constitution. Delivering a lecture to mark the court’s 150th anniversary, Bagbin traced its journey from its establishment in 1876 through various political eras, noting its pivotal role in upholding constitutional supremacy, safeguarding fundamental rights, and steering the nation through critical moments such as the 2012 election petition. He praised the court for helping maintain democratic stability without derailing the country’s progress.

While commending the judiciary’s contributions, the Speaker cautioned against two extremes: judicial overreach into areas best handled by Parliament and the Executive, and undue restraint when constitutional rights or democratic institutions face genuine threats. He called for greater consistency in constitutional interpretation to reduce uncertainty among citizens, legislators, and investors, and emphasised that the relationship between Parliament and the Judiciary should be one of partnership rooted in mutual respect for their respective mandates.

Looking to the future, Bagbin urged the Supreme Court to confront emerging challenges including artificial intelligence, data protection, climate change, and cross-border commerce by becoming more independent, transparent, and accessible.

The honourable speaker concluded with a charge to the court that every ruling should leave the Constitution stronger than it found it, setting a clear vision for the next 150 years of judicial service to Ghana’s democracy.
